The sale of goods & the provision of services by Beny Sports Co. UK Ltd. are subject to the following Terms & Conditions. Any change or deviation to these Terms & Conditions will only be honoured if stated in writing by a Director or other authorised representative of Beny Sports Co. UK Ltd.

Making a contract with us

When you place an order with us, you are making an offer to buy goods. 

We will send you an e-mail to confirm that we have received your order.

Once we have checked the price and availability of the goods, we will e-mail you again to confirm that we are processing your order, and that a Contract has been made between us. 

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this.  As a result, you will receive an e-mail confirming cancellation of your order, your payment will be refunded in full to the original method of payment and there will be no Contract between us.

If the selected goods are not available, we may supply you with substitute goods that equal to or surpass the specification of the selected goods.  If you decide not to accept the substitute goods, we will collect them for a full refund at no cost.

How to place an order

Please use the Checkout facility within our online store and follow the on screen instructions to enter your delivery and payment details.

Title

All goods shall remain the legal property of Beny Sports Co. UK Ltd. until payment has been received in full.

No goods or services will be provided unless payment has been received in full.

Any item offered with a deposit option must be paid for in full prior to dispatch. 

Delivery/Collection

We aim to dispatch goods within 1 working day after an order being placed - this is in addition to our advertised delivery time.  Normal delivery time can take up to three working days to arrive - if after this time the item(s) have not been delivered, please contact us.  Express delivery is also available to Mainland England, Wales & lower Scottish areas at a premium and can be purchased during the checkout process.

All deliveries are made on a "door to door" basis, the carrier will not be instructed to carry any items inside your property. 

Any delivery requested outside the carrier’s normal operating hours will attract a pre-determined, agreed surcharge.

All goods will require a signature upon receipt. If any instruction is given by the customer for the delivery company to leave goods unattended or not with the recipient detailed within the order details, it will be left entirely at the purchasers risk.

If the goods, sent via a reputable third-party carrier, are damaged in transit, please either: -

a). Refuse delivery if the packaging is badly damaged & you suspect that there has been significant damage to the goods.  Note the reason on the carrier’s signature system & advise us promptly by e-mail that you have done so.

b). Take delivery of the goods but sign for them as damaged if you suspect that the damage to the goods could be non-existent or superficial & advise us promptly by e-mail that you have done so.

If the goods are collected by the customer or their representative all risks of loss or damage pass to the Customer once the goods have been loaded onto the customers’ designated transport.

If you suspect that the goods are lost in transit because they are at least 48 hours overdue from the time that you expected them to be delivered, please contact us by e-mail.

Cancellation & returns

You can cancel your Contract with us at any time up to 14 working days after the day of delivery.  To do this, please e-mail us or write to us for our authorisation.

You do not have to give any reason for cancellation.  However, a brief explanation will help us to improve the service we offer to customers in the future.

If you cancel your Contract with us, you must return the goods to us at your own expense.  You must ensure that the goods are unused & re-packaged adequately in the original packaging to protect against damage.

If you refuse the delivery on the grounds that you no longer want the goods, we reserve the right to charge you the direct cost of the return shipping passed onto us by the carriers.  

Any premium shipping cost paid above our free delivery offer will not be refunded.

If you fail to return the goods, we will arrange to collect during the normal working day* at an unspecified time & we will charge you the direct cost of collection.  If you fail to take reasonable care of the goods before they are returned to us & this results’ in damage or deterioration of the goods, we will charge you for the reduction in value.

Any deposits paid are non refundable, unless were unable to fulfil the order within specified time frames.

*Note: - Saturdays, Sundays and Public Holidays are not considered normal 'working' days. 

 

Faulty goods

If there is a problem with the goods, please contact us by e-mail or telephone our Customer Support Department on 01535 637711  (UK ONLY)

We will deal with the matter in accordance with your legal rights.

 

Specifications

Specifications are subject to change without prior notice at the discretion of Beny Sports Co. UK Ltd. While every effort shall be made to provide reasonable notice of changes, we cannot be held responsible for problems arising from necessary changes. We reserve the right, in accordance with our Terms & Conditions above to offer substitute goods of an equal or better specification.

Unless stated otherwise, all Capacities, Colours, Dimensions, Performance Levels & Weight Limits, are to be considered approximate.

Product Use & Warranty

We undertake to repair or replace at our discretion, any product or component that becomes faulty during the first 12 months after purchase. This is wholly dependent upon the customer having: -

i) Mailed the Product Warranty Registration Card within 14 days of purchase to us for Warranty registration.

ii) Notified our Customer Support Department without any undue delay as to the nature of the problem.

iii) Returned the product or component to our Customer Support Department if requested, with proof of purchase, at their cost, for examination.

We reserve the right to refuse to repair or replace any product or component without nominal charge, should the customer not be able to provide proof of purchase.

All products supplied by Beny Sports Co. UK Ltd. are deemed suitable for Domestic Use only (unless otherwise advised), and are designed to comply with the relevant BS-EN957 & other applicable Standards.

No warranty, given or implied will be valid for products that have been used in a commercial or non-domestic environment.

The warranty will be invalidated on products that have been abused or not maintained within guidelines clearly set out in assembly and user instructions provided with all products.

The warranty is not transferable and is wholly to the benefit of the original purchaser.

Changes to these terms

These terms were last changed on 11th January 2017

We may change our terms and conditions at any time, so please do not assume that the same terms will apply to any future orders.

 

These Terms & Conditions do not affect the Statutory Rights given by English Law to the consumer
